By accessing or using FYMC Trend Tracker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

SERVICE DESCRIPTION

FYMC Trend Tracker is a subscription-based market signal dashboard providing trend bias indicators, strength scores, and related analysis for futures markets and U.S.-listed stocks. The Service is provided for educational and informational purposes only.

ELIGIBILITY

The Service is currently available to users located in the United States and Canada only. By subscribing, you represent that you are located in one of these countries and are at least 18 years of age.

SUBSCRIPTION & BILLING

Plans: Standard tier is available at $99.99/month or $999/year (after applicable Charter or promotional discounts). Premium tier is unlocked through referrals and is not separately purchasable.

Charter Members: Users who subscribe before the Charter enrollment window closes receive a lifetime discount (50% off) for as long as their subscription remains active.

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually). Payments are processed by Stripe.

Cancellation: You may cancel your subscription at any time through Stripe's customer portal or by contacting us. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing cycle.

Refunds: All sales are final. We do not offer refunds except as required by applicable law or at our sole discretion.

REFERRAL PROGRAM

Subscribers may earn referral discounts by sharing their unique referral code. Each qualifying referral beyond the Premium unlock threshold earns 15% off the next billing cycle, capped at 75% per cycle. Unused discounts carry over. Referral benefits reset upon subscription cancellation.

ACCOUNT RESPONSIBILITY

You are responsible for maintaining the confidentiality of your account credentials. You may not share, resell, or redistribute access to the Service. One subscription per individual — shared or multi-user access is prohibited.

NOT FINANCIAL ADVICE

Trend Tracker is not trading advice. The information provided by the Service does not constitute investment advice, financial advice, trading advice, or any other sort of advice. You should not treat any of the Service's content as such.

FYMC and its operators do not solicit or execute trades, do not give investment advice, and are not registered as brokers or advisors with any federal or state agency.

HYPOTHETICAL RESULTS DISCLAIMER

This website may contain references to hypothetical trading results.

HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS, SOME OF WHICH ARE DESCRIBED BELOW. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. IN FACT, THERE ARE FREQUENTLY SHARP DIFFERENCES BETWEEN HYPOTHETICAL PERFORMANCE RESULTS AND THE ACTUAL RESULTS SUBSEQUENTLY ACHIEVED BY ANY PARTICULAR TRADING PROGRAM.

ONE OF THE LIMITATIONS OF HYPOTHETICAL PERFORMANCE RESULTS IS THAT THEY ARE GENERALLY PREPARED WITH THE BENEFIT OF HINDSIGHT. IN ADDITION, HYPOTHETICAL TRADING DOES NOT INVOLVE FINANCIAL RISK, AND NO HYPOTHETICAL TRADING RECORD CAN COMPLETELY ACCOUNT FOR THE IMPACT OF FINANCIAL RISK IN ACTUAL TRADING.

THERE ARE NUMEROUS OTHER FACTORS RELATED TO THE MARKETS IN GENERAL OR TO THE IMPLEMENTATION OF ANY SPECIFIC TRADING PROGRAM WHICH CANNOT BE FULLY ACCOUNTED FOR IN THE PREPARATION OF HYPOTHETICAL PERFORMANCE RESULTS AND ALL OF WHICH CAN ADVERSELY AFFECT ACTUAL TRADING RESULTS.

RISK DISCLOSURE

Past performance is not necessarily indicative of future performance. The risk of loss in trading futures contracts, commodity options, or forex can be substantial. You should carefully consider whether such trading is suitable for you in light of your circumstances and financial resources. Users are solely responsible for their own trading decisions.

LIMITATION OF LIABILITY

The Service is provided "as is" without warranties of any kind. FYMC shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of the Service, including but not limited to trading losses, data loss, or service interruptions.

INTELLECTUAL PROPERTY

All content, data, analysis, methodology, and branding associated with FYMC Trend Tracker is the property of Camp Hopeless, LLC, operating as Fuck You Money Capital. Unauthorized reproduction, distribution, or commercial use is prohibited.

This includes, without limitation: the trend signals, trend scores, state classifications, and all underlying methodology; historical and current market data as compiled, derived, or presented by the Service; the visual design, layout, interface, graphics, iconography, color systems, and user experience of the Service; all source code, markup, and stylesheets; and all copy, documentation, and brand assets.

AUTOMATED ACCESS, SCRAPING & AI TRAINING

The following are expressly prohibited and constitute a violation of these Terms and misappropriation of the intellectual property of Camp Hopeless, LLC:

Automated extraction. Accessing the Service by any automated means, including scrapers, crawlers, spiders, bots, headless browsers, scripted requests, or any other software or process designed to extract, harvest, index, monitor, or copy data or content from the Service, whether in whole or in part.

AI and machine learning use. Using any content, data, output, design, or asset of the Service to train, fine-tune, ground, augment, evaluate, benchmark, or otherwise develop any artificial intelligence or machine learning model, dataset, embedding, index, or system. This prohibition applies whether the use is commercial, academic, or personal, and regardless of whether the content is transformed, aggregated, summarized, or combined with other sources.

Derivative and imitative works. Reproducing, adapting, or imitating the visual design, layout, interface, user experience, graphics, or presentation of the Service, in any medium, in whole or in substantial part.

Authorized retrieval channels only. Data and content may be obtained from the Service only by viewing it in the Service's own interface, or by using the export functions the Service itself provides (including CSV, XLS, and any other on-page or in-app export or download feature), and only while signed in under a valid account and subscription tier entitling you to that content. Obtaining, or attempting to obtain, data or content by any other means is prohibited. This includes, without limitation: direct calls to backend databases, APIs, endpoints, or cloud services underlying the Service; use of REST, SDK, or other programmatic interfaces not expressly offered to you as a documented product feature; intercepting, replaying, reconstructing, or reverse-engineering the Service's network requests; extracting or reusing authentication tokens, session credentials, keys, or identifiers outside the Service's own interface; reading data from browser storage, memory, developer tools, or page source; and automating or driving the Service's interface to perform bulk retrieval.

Circumvention. Bypassing or attempting to bypass authentication, rate limiting, access controls, subscription gating, or any technical measure that restricts access to the Service.

Redistribution. Republishing, reselling, syndicating, mirroring, or making available to third parties any content or data obtained from the Service, including through derived products, feeds, dashboards, newsletters, or reports.

No provision of these Terms grants any license, express or implied, to use the Service or its contents for artificial intelligence training or automated data collection. Any such use is unauthorized and unlicensed. Where applicable, this notice constitutes an express reservation of rights, including for the purposes of Article 4(3) of Directive (EU) 2019/790 and any analogous text-and-data-mining reservation available under applicable law.

Access to the Service by any automated agent constitutes acceptance of these Terms by the operator of that agent. We may block, rate limit, or terminate access at our sole discretion, without notice, and may pursue all remedies available at law or in equity, including injunctive relief, damages, and recovery of costs and attorneys' fees.

Exported data, including CSV exports made available to subscribers, is licensed solely for the individual subscriber's personal or internal business use. It may not be redistributed, published, or used for any purpose prohibited by this section.

MODIFICATIONS

We reserve the right to modify these terms, pricing, features, or the Service itself at any time. Material changes will be communicated via the Service. Continued use constitutes acceptance of updated terms.

GOVERNING LAW

These terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law provisions.
